1. Nature and Scope of Our Services
1.1 All inspections offered by IAR are non-invasive and visual in nature, meaning no mechanical work is performed and no parts are dismantled.
1.2 The specific scope of your chosen inspection package may vary. Please refer to the relevant service description and the Inspection Type-Specific Terms in Attachment 1.
1.3 IAR coordinates inspections via experienced inspectors, some of whom may operate as independent contractors under agreement with us.
2. Fees, Changes, and Cancellations
2.1 Booking and Payment: You agree to pay the full fee applicable to the selected inspection service at the time of booking.
2.2 Rescheduling Policy:
– You may reschedule a booking up to two times.
– Further rescheduling will require cancellation and rebooking.
2.3 Cancellations by You:
– 24+ hours notice: Full refund.
– Less than 24 hours: Refund minus 40% cancellation fee.
– Less than 2 hours: Refund minus 60% cancellation fee.
2.4 Cancellations by Us: We reserve the right to decline or cancel a booking at our discretion (e.g. unsuitable vehicle type or unsafe location). In such cases, a full refund will be provided.
3. Inspection Conditions and Process
3.1 Once booked, an IAR representative or authorised inspector will contact the nominated party to confirm inspection time and location.
3.2 The item to be inspected must:
– Be located on a stable, level surface;
– Be in a safe, accessible area;
– Have clear access around it for inspection.
3.3 If inspection conditions are not met:
– We may proceed with a limited-scope inspection; or
– You may cancel with 24+ hours’ notice and receive a full refund.
3.4 Road Test Requirements:
Where applicable, the vehicle must:
– Be roadworthy and registered;
– Contain adequate fuel or charge for testing.
We may decline to road test vehicles that appear unsafe or unregistered.
3.5 Uncontrollable Events:
We are not liable for delays or cancellations due to external factors such as severe weather or traffic incidents, but will offer to reschedule at no extra charge.
4. Inspection Reports and Their Use
4.1 Some services include a written, video, or digital report (“Report”) summarizing findings at the time of inspection.
4.2 The Report is provided for informational purposes only and does not constitute a recommendation to purchase or avoid purchasing the inspected vehicle.
4.3 You understand that:
– Reports reflect the condition of the vehicle at the time of inspection only;
– We are not responsible for any faults that develop after the inspection;
– Reports are not roadworthy certificates and cannot be used as such.
4.4 Reports must not be reproduced, published, or shared publicly without our prior written consent.
5. Your Responsibilities
5.1 You must ensure that the vehicle is available at the agreed time and place, and that the owner/seller grants access to the inspector.
5.2 You must disclose any material facts you’re aware of regarding the vehicle (e.g. service history, accident history, modifications, or if the vehicle is unregistered). We rely on this information being accurate and complete.
6. Liability and Limitations
6.1 Australian Consumer Law: Nothing in these terms excludes your rights under applicable consumer protection legislation.
6.2 To the extent permitted by law:
– We disclaim all warranties not expressly stated here;
– Our maximum liability is capped at the greater of $1,000 or five times the inspection fee paid;
– We are not liable for indirect or consequential loss, including loss of use, data, income, or resale value.
6.3 We are not responsible for:
– Disputes between you and any third party (e.g. seller);
– Accuracy of odometer readings, VIN matching, or security/finance checks.
6.4 “We” or “IAR” includes our staff, contractors, directors, and agents.
7. Intellectual Property
7.1 All content, tools, and reports provided by IAR remain our intellectual property.
7.2 You are granted a limited license to use the Report for personal decision-making. Any commercial use, duplication, or sharing of the content requires our written permission.
8. Privacy
8.1 We collect and handle personal information (e.g. your name, email, phone, vehicle details) in accordance with our Privacy Policy, available on our website.
9. Changes to These Terms
9.1 These terms may be updated from time to time. Any changes will apply to future bookings only, and not retrospectively.
10. Governing Law
10.1 These terms are governed by the laws of Victoria, Australia, and any disputes will be resolved in Victorian courts.
Attachment 1 – Inspection Type-Specific Terms
a. Inspections may not detect latent faults or internal mechanical issues that are not externally visible.
b. Our inspectors follow best-practice procedures, but no inspection can guarantee fault-free operation.
c. Reports do not assess alignment with manufacturer specifications (e.g. trim, badge authenticity).
d. We do not check for recall notices, odometer tampering, or stolen vehicle history.
e. You are responsible for conducting any legal or financial checks (e.g. PPSR, encumbrance, write-off status).
f. We do not guarantee that any vehicle will pass a roadworthiness test, regardless of inspection outcome.
g. Reports should be viewed in light of the vehicle’s age, condition, and intended use.
